			<content:encoded><![CDATA[<p>Bankrupt Golden Guernsey Dairy LLC has received support for the sale of its assets by its two major creditors; however, this support is largely contingent on whether the creditors can recover the debts they are owed by the company.</p>
<p>The proposed sale of bankrupt Golden Guernsey Dairy LLC, which filed for <a href="http://www.bankruptcylawyerinmilwaukee.com/articles/can-i-file-for-chapter-7-bankruptcy/">Chapter 7 bankruptcy</a>, has the support of Accord Financial of Greenville, S.C., and Baraboo-based Foremost Farms USA if they are paid from the proceeds of the sale. However, because Golden Guernsey owes nearly $7.9 million to Accord Financial and $1.8 million to Foremost Farms, the current bid for $5.5 million made by Ohio-based LEL Operating Company is not enough to cover all the debts.</p>
<p>The purchase agreement for LEL includes company assets, Golden Guernsey Dairy LLC&#8217;s property, and their intellectual property rights.</p>
<p>A bankruptcy auction will be held on May 14 if there are at least 2 qualified bidders, while a purchase hearing is set for June 4th.</p>

			<content:encoded><![CDATA[<p>For the third time since 2008, Vertis Holdings Inc. has filed for bankruptcy.  This time, the company has asked the bankruptcy court to supervise as it sells itself to Quad/Graphics Inc.</p>
<p>Vertis Holdings, an advertising insert creator, has agreed to auction itself to the lead bidder, Wisconsin-based Quad/Graphics, for the offer of $258.5 million. According to court papers filed in the <a href="http://www.deb.uscourts.gov/" target="_blank">U.S. Bankruptcy Court in Wilmington, Delaware</a>, Vertis Holdings listed $700 million in debt in their <a href="http://www.bankruptcylawyerinmilwaukee.com/articles/filing-for-bankruptcy-a-second-time/">second bankruptcy</a>, which was filed in 2010.</p>
<p>The company will borrow $150 million in order to continue its operations until it is auctioned. Quad/Graphics Inc. also makes advertising inserts that are later placed into magazines and other forms of direct mail.</p>

			<content:encoded><![CDATA[<p>The digital production company that created the visual effects for <em>Titanic</em> has filed for Chapter 11 <a href="http://www.bankruptcylawyerinmilwaukee.com/">bankruptcy</a> less than a year after going public. The company, Digital Domain Media Group, Inc., was founded in part by James Cameron, director of the <em>Titanic.</em></p>
<p>The company has agreed to sell the core of its business for $15 million to a private investment company. Digital Domain also did the effects for box office hits including <em>Transformer</em> series, and it most recently presented the Tupac Shakur hologram at this year&#8217;s Coachella festival.</p>
<p>According to court documents, the company stated that it was low on capital and did not have any ideas on how to generate more. It also stated that it did not have enough money to <a href="http://www.bankruptcylawyerinmilwaukee.com/articles/debt-restructuring/">restructure its debt</a> while keeping up with expenses associated with operating the business. The company listed assets of $205 million  and liabilities at almost $215 million as of June 30th of this year.</p>

			<content:encoded><![CDATA[<p>The Wisconsin-based Triad Group and sister company, H&amp;P Industries, have <a href="http://www.bankruptcylawyerinmilwaukee.com/practice-areas/chapter-7-bankruptcy/">filed for bankruptcy</a> as a way to restructure after facing dozens of lawsuits surrounding defective medical products made by the company.</p>
<p>In addition to the bankruptcy case, Triad Group must follow a plan set forth by the Food and Drug Administration to update its safety standards in order to resume operations. Officials have said that the company has &#8220;high hurdles&#8221; to pass in this regard.</p>
<p>In January 2011, Triad Group and H&amp;P Industries announced a recall of alcohol wipes and swabs after it was found that they were contaminated with a bacteria called <em>Bacillus cereus</em>. This contamination is linked to the deaths of 11 people, including a two-year-old Houston boy.</p>
<p>As a result of the defective products, the company is involved in 22 lawsuits across 19 states. Although 13 of these lawsuits have been settled, 30 other claims have been filed but have yet to be made into lawsuits. Some fear that because of the bankruptcy filings, plaintiffs involved in the lawsuits and claims will not receive what they are asking for.</p>
<p>The company listed $33 million in liabilities and $8.6 million in assets.</p>

<p>According the <a href="http://www.wieb.uscourts.gov/">U.S. Bankruptcy Court of the Eastern District of Wisconsin</a> in Milwaukee, the number of new bankruptcy claims that were filed in the second quarter of 2012 reached 5,902, a 0.8% increase from the second quarter of 2011, during which there were 5,855 filings. However, this year&#8217;s number is still 1.6% less than the second quarter of 2010.</p>
<p>The type of bankruptcy linked to the past year&#8217;s increase in filings is <a href="http://www.bankruptcylawyerinmilwaukee.com/practice-areas/chapter-13-bankruptcy/">Chapter 13</a> bankruptcy. The number of Chapter 13 filings increased from 1,208 in the second quarter of 2011 to 1,423 in the second quarter of 2012. This type of bankruptcy allows for a person to reorganize the debt that he or she has and pay it off through a repayment plan administered by a court-appointed bankruptcy trustee.</p>

<p>The lawsuit was filed on Friday in New York. Officials with American Airlines are hoping that a bankruptcy judge will see this cost-cutting attempt as a “sound business judgment.”</p>
<p>The company also stated that it never promised to provide the benefits for life,  and it has the right to change the scope of benefits whenever it sees fit. The company currently has about 40,000 retirees.</p>
<p>Officials with AMR Corp. stated that the changes to the benefits plan will be similar to what the current active employees will receive when they retire. The spokesperson also said that the bankruptcy restructuring process is something that is difficult for everyone, and they understand that a change in benefits may be very &#8220;concerning.&#8221;</p>

<p>For the entire Western District of New York, which includes nearly 10 counties, the overall number of filings rose 1.8 percent.  Bankruptcy experts have stated that the number of filings may not be a sign that the recession is slowing because there are still many people that are in trouble financially.</p>
<p>According to <a href="http://www.buffalonews.com/"><em>Buffalo News</em></a>, local experts are trying to determine whether the slight increase is a sign that the economy is on its way to recovery or a sign of a big change.</p>

<p>The bankruptcy filing is currently  being investigated by the federal authorities. Two years ago, the company moved to Rhode Island because of a $75 million state loan guarantee, but it has now (along with its sister company) filed for liquidation  bankruptcy.</p>
<p>According to <em><a href="http://www.kwwl.com/">KWWL online</a></em>, the company, 38 Studios, owes $150.7 million and it has assets of just over $20 million.  The company fired its staff last month. The sister company, 38 Studios Baltimore owes more than $121.4 million.</p>
