Bankruptcy preparer files for bankruptcy

Earlier this month, a non-lawyer bankruptcy preparer who had been banned by a bankruptcy judge from preparing bankruptcy petitions recently sought bankruptcy protection herself. The bankruptcy preparer was fined $46,000 after the judge found out that she was still preparing bankruptcies and often filing documents with errors that caused cases to be thrown out.

The preparer filed for Chapter 13 bankruptcy, but failed to provide certain important documents, putting her case at risk of being thrown out. Missing papers included a disclosure of her monthly income and a statement of financial affairs. After receiving the case, the bankruptcy judge handleing the Chapter 13 filing put in an order for “possible future dismissal of case.”

T-Boz’s third bankruptcy dismissed by judge

T-Boz, a singer in the R&B girl group TLC, recently had her Chapter 13 bankruptcy case dismissed by a judge in Atlanta. The singer previously filed for bankruptcy last February, but this case was also thrown out. Also, T-Boz and the rest of TLC filed for Chapter 11 bankruptcy in 1995 when they were beginning to gain fame.

The Chapter 13 bankruptcy case was dismissed because the judge felt that creditors provided sufficient evidence that T-Boz had not been making an effort to follow through with the bankruptcy process. For example, creditors told the judge that the singer had not appeared at meetings to negotiate their debts, made any payments to resolve her debt, filed paperwork required in Chapter 13 bankruptcy, or attempted to recover $250,000 of child support she is owed.

T-Boz can refile for bankruptcy 180 days after the day that the judge threw out her latest Chapter 13 filing. In the meantime, creditors may attempt to seize any of the singer’s assets.

SE Wisconsin foreclosures rise by 4.6 percent in Jan.

In southeastern Wisconsin, foreclosures increased by 4.6 percent last month.  Courts in Milwaukee, Kenosha, Racine, Waukesha, Ozaukee, Washington, and Walworth counties received 1,018 mortgage foreclosures in January.

The amount of foreclosures filed in southeastern Wisconsin last month is 4.6 percent higher than the amount filed in January 2011.  Milwaukee County had the most foreclosures in January with a total of 542.  Kenosha had the most significant year-over-year increase at 24.2 percent.

Foreclosures also increased in Waukesha County from 111 last year to 123 this year.  Racine, Ozaukee, Washington, and Walworth all saw a decrease in foreclosures last month.

Bankruptcies down statewide in 2011

The total number of bankruptcies filed in the state of Wisconsin in 2011 was lower than the total number of bankruptcies filed in 2010.  Experts say this is the first statewide decrease in bankruptcy filings in Wisconsin in 6 years.

Bankruptcies decreased by about 10 percent, with approximately 27,000 bankruptcies filed in the state last year.  Chapter 7 bankruptcy was the most popular type of bankruptcy in Wisconsin, accounting for almost 80 percent of the state’s total bankruptcy petitions.

Chapter 7 bankruptcy allows unsecured debts like credit card debt to be eliminated, and provides liquidation exemptions for certain types of property.  In addition, by filing for Chapter 7 bankruptcy, one is able to improve their credit score.

Lee Steinberg files for Chapter 7 bankruptcy

Recently, sports agent Lee Steinberg filed for Chapter 7 bankruptcy.  The agent is famous for representing top athletes like Troy Aikmen and inspiring the 1996 film “Jerry Maguire” and its main character.

Steinberg currently owes $1.4 million in a lease for a property in Newport Beach.  The Chapter 7 bankruptcy filing lists total debts between $1 and $5 million, and only one asset of $475,000 in stock.

The sports agent said he accumulated debt while he was in rehab to recover from an alcohol addiction, and his business suffered as a result of these debts.  Steinberg says he has been sober since 2010.

Hundreds volunteer in Milwaukee for MLK Day

On Monday, about 400 people volunteered with City Year of Milwaukee to honor Dr. Martin Luther King, Jr.’s commitment to civil rights and service.  The organization says that MLK Day is their biggest service day of the year.

One of the projects City Year planned involved 5 hours of work to beautify and repair Alexander Hamilton High School.  More than 50 students showed up at the school on their day off to help with the projects.

City Year of Milwaukee used a grant from Volunteer Wisconsin to purchase equipment and materials needed for their MLK Day service projects.  Volunteer Wisconsin helps organize service projects and groups throughout the state.

Personal bankruptcies drop in 2011

A recent analysis from the National Bankruptcy Research Center shows that personal bankruptcies decreased in 2011.  Last year, 1.35 million people in the U.S. filed for personal bankruptcy–a 12 percent decrease from the 1.5 million personal bankruptcies filed in 2010.

Based on this information, approximately 1 in every 175 Americans filed for Chapter 7 or Chapter 13 bankruptcy in 2011.  17 percent fewer Chapter 7 bankruptcies and 25 percent fewer Chapter 13 bankruptcies were filed in the U.S. last year.

Chapter 7 bankruptcy and Chapter 13 bankruptcy are the most frequently filed types of bankruptcy.  Under Chapter 7 bankruptcy, individuals liquidate some of their assets to pay off their debts, and under Chapter 13 bankruptcy, filers create a repayment plan to repay creditors over a certain time period.

Former NBA athlete struggles with bankruptcy

Retired NBA star Antoine Walker has been accused by his daughter’s mother of failing to pay child support and tuition for his 13 year-old daughter. Walker appeared in court last week, but a federal judge will have to decide whether or not the case can proceed since he has filed for Chapter 7 bankruptcy.

Along with $117,000 in unpaid child support and nearly $28,000 in school costs for his daughter, the 35 year-old owes $1.2 million to casinos and $2 million on a house he bought his mother. Walker is on probation after pleading guilty to not paying $750,000 he owes to three different Las Vegas casinos.

During his 13 year career in the NBA, he is estimated to have earned $110 million.

Saab turns in bankruptcy application

Saab’s chief executive handed in the Swedish automaker’s bankruptcy application to a Vänersborg courthouse on Monday.

For the past two years Saab has tried to revive its company with its last attempt thwarted by General Motors, which owned the company for twenty years. Saab was trying to transfer technology to Chinese investors who planned to save the firm, but GM refused since it still owns some of Saab’s technology licenses. Experts say, however, that Chinese investors would not have been able to save Saab.

Saab is expected to be liquidated with GM buying its patent rights to use on existing or new models.

Southeastern Wisconsin foreclosures up in Novemeber

Last month, foreclosures in southeastern Wisconsin increased to 1,011 from 865 in November 2010 — a 16.9 percent year-over-year increase.  In Milwaukee County, foreclosures increased by 13.5 percent to 528.

Southeastern Wisconsin includes Milwaukee, Kenosha, Racine, Ozaukee, Washington, Walworth, and Waukesha counties.  November was only the second month of the year in which foreclosure filings in southeastern Wisconsin reached over 1,000 filings.  From January 2010 through November 2010, total monthly foreclosures were higher than 1,000 six times.

For the first 11 months of this year, foreclosure filings in southeastern Wisconsin totaled 9,763 — a 14 percent decrease from foreclosures filed in the same time period last year.

Experts say foreclosures increased in November because some cases that were delayed because of paperwork issues have moved on to being processed through the foreclosure system.
