Creditors file involuntary bankruptcy against car dealership

Earlier this month, three creditors filed an involuntary bankruptcy petition against the Don Jacobs Mitsubishi car dealership in Milwaukee. The car dealership is currently closed.

The Chapter 7 bankruptcy filing was filed against Don Jacobs Imports, LLC, and claims debts of approximately $47,000. The creditors filed the bankruptcy in an attempt to stop a lawsuit from being filed against the car dealership by Boucher Automotive Group.

Bankruptcy preparer files for bankruptcy

Earlier this month, a non-lawyer bankruptcy preparer who had been banned by a bankruptcy judge from preparing bankruptcy petitions recently sought bankruptcy protection herself. The bankruptcy preparer was fined $46,000 after the judge found out that she was still preparing bankruptcies and often filing documents with errors that caused cases to be thrown out.

The preparer filed for Chapter 13 bankruptcy, but failed to provide certain important documents, putting her case at risk of being thrown out. Missing papers included a disclosure of her monthly income and a statement of financial affairs. After receiving the case, the bankruptcy judge handleing the Chapter 13 filing put in an order for “possible future dismissal of case.”

T-Boz’s third bankruptcy dismissed by judge

T-Boz, a singer in the R&B girl group TLC, recently had her Chapter 13 bankruptcy case dismissed by a judge in Atlanta. The singer previously filed for bankruptcy last February, but this case was also thrown out. Also, T-Boz and the rest of TLC filed for Chapter 11 bankruptcy in 1995 when they were beginning to gain fame.

The Chapter 13 bankruptcy case was dismissed because the judge felt that creditors provided sufficient evidence that T-Boz had not been making an effort to follow through with the bankruptcy process. For example, creditors told the judge that the singer had not appeared at meetings to negotiate their debts, made any payments to resolve her debt, filed paperwork required in Chapter 13 bankruptcy, or attempted to recover $250,000 of child support she is owed.

T-Boz can refile for bankruptcy 180 days after the day that the judge threw out her latest Chapter 13 filing. In the meantime, creditors may attempt to seize any of the singer’s assets.

SE Wisconsin foreclosures rise by 4.6 percent in Jan.

In southeastern Wisconsin, foreclosures increased by 4.6 percent last month.  Courts in Milwaukee, Kenosha, Racine, Waukesha, Ozaukee, Washington, and Walworth counties received 1,018 mortgage foreclosures in January.

The amount of foreclosures filed in southeastern Wisconsin last month is 4.6 percent higher than the amount filed in January 2011.  Milwaukee County had the most foreclosures in January with a total of 542.  Kenosha had the most significant year-over-year increase at 24.2 percent.

Foreclosures also increased in Waukesha County from 111 last year to 123 this year.  Racine, Ozaukee, Washington, and Walworth all saw a decrease in foreclosures last month.
