How long do personal bankruptcy cases last?

The length of a bankruptcy case typically depends on the facts and circumstances of the case. However, statistics suggest that Chapter 7 bankruptcy cases usually last fewer than 6 months, while Chapter 13 cases will last for 3 to 5 years.

However, these numbers are averages, and certainly represent the lower bound for complex cases. These cases often include complicated and tangled debt payments, which will take both lawyers and the court more time to unravel.

Along with the complexity of the case, the person’s preference for bankruptcy protection will also determine the length of the case. If the person is aggressive in restructuring payments and getting out of debt payments, the case may take longer.
