Staving off the Repo Man
When you buy an expensive item on credit, such as a car, a television, or furniture, you do not technically own that item until the debt is completely paid off. Usually the company that sold the item to you will take out what is called a security interest. This means that if you default on your payments or even make a late payment on your credit bill, the company has the right to take back the item that they sold to you. To help with the repossession process, companies often hire repossession agents, commonly known as “repo men.”
If you have failed to make a timely payment on your car or other property, you may answer a knock on your door and find a repo man standing there. Under the law, he or she cannot enter your home without your permission. Your best option is to not let them in and contact a lawyer for help. Sometimes repossession agents will try to break in to your house or otherwise unlawfully conduct the repossession. If this happens to you, call the police immediately. If the item in question is your car, do not leave it parked on the street or out in the driveway where a repossession agent can easily tow it.
Once your property has been taken, it is very difficult to get it returned to you, even if you are able to make up the missed payments. It is therefore extremely important to contact a lawyer as soon as possible when you find out that your creditor is threatening or attempting repossession. A repossession defense lawyer can negotiate with the creditor on your behalf and try to arrange to have the repossession efforts stopped.
